The Thompson Okanagan Industry Shout Out & Enter to Win draw is limited to professionals representing a tourism related company operating in a community in the Thompson Okanagan region of British Columbia.

The Thompson Okanagan Tourism Association (TOTA) (the “sponsor”) survey and contest (the "contest") will be conducted in Canada (excluding the province of Quebec) and shall be subject to and evaluated according to, applicable Canadian law. The draw is limited to one entry per person. No purchase is necessary. Entry into this contest constitutes acceptance of these contest rules.
How to Participate
1.1 Eligibility: To be eligible for the contest, the entrant must:
a) Be a legal resident of Canada (excluding the province of Quebec)
b) be of the age of majority in their province or territory of residence, or older at the time of entry; and
c) work with a tourism related company operating in or community in the Thompson Okanagan region of British Columbia
1.2 Non-Eligibility:
a) Employees of TOTA and its subsidiaries
b) Any other individual involved in the development, production, administration, or fulfillment of the Contest; and
c) Members of the immediate family (brothers, sisters, children, father, mother, spouse) of the individuals outlined in 1.2 a
d) Household members of any of the parties listed above.
Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Sponsor for the purpose of the Contest must be truthful, complete, accurate, and in no way misleading. Sponsor reserves the right, in their sole discretion, to disqualify any Entrant should such an Entrant at any stage supply information that does not meet these requirements.
1.3 Contest Period & Participation: Starting when the newsletter is sent and ending end of day Friday two weeks later (“Contest Period”), entrants may participate in the Contest by completing the online form. The Entrants participating via completion of the survey must clearly and fully complete the survey with all requested information.
1.4 Contest Entry: Upon completion and submission of the survey, eligible Entrants will be entered into the Contest for one (1) chance to win the Prize (described below).
1.5 Contest Entry Restrictions: Entrants are restricted to one (1) entry per person. Any excess entries will be invalid for purposes of the Contest draw.
1.6 Awarding of Prize: The Prize will be awarded to the Entrant whose contact information has been given by the Entrant through the survey and who has complied with these Rules.
2. Prize
2.1 One Available Prize: There is one (1) prize available to be won, as announced in the newsletter.
2.2 Prize Acceptance: The Prize must be accepted as awarded. No cash alternatives, substitution or transfers of the Prize will be allowed. The Winner is not entitled to the monetary difference between the actual Prize value and stated approximate Prize value, if any. The Prize will be forwarded to the Winner within two (2) to four (4) weeks from the date when the Winner’s signed Declaration and Release Form along with the correct answer to a skill testing question is received by Sponsor.
2.3 Odds: The odds of being randomly selected to win the Prize depend on the total number of eligible entries received during the Contest Period.
2.4 Prize Draw: The Prize will be awarded by random draw in Kelowna, B.C., from ALL eligible Contest entries received during the Contest Period (the “Draw”).
2.5 Notification of Selection: The selected Entrant will be contacted by phone or email (using the contact information provided by Entrant at least three (3) times within the fourteen (14) days after the Draw. If the selected Entrant cannot be contacted in that time, another Entrant will be randomly selected and the initial selected Entrant will be disqualified and will have no recourse towards TOTA or anyone involved in the Contest. In order to win, the selected Entrant must first correctly answer, unaided, a time-limited, mathematical, skill-testing question to be administered by telephone or email, and he/she/they will be required to sign a standard Declaration and Release Form confirming compliance with the Contest Rules, acceptance of the Prize as awarded and releasing TOTA from all liability relating to the Contest or Prize. The selected Entrant will have seven (7) days from the date of receipt to return a signed copy of the Declaration and Release Form to Sponsor. If the selected Entrant does not do so within this period of time, another Entrant will be randomly selected and the initial selected Entrant will be disqualified and will have no recourse towards TOTA, or anyone involved in the Contest.
3. Survey Responses
3.1 Data Collected. TOTA may use an Entrant’s responses (which may include information such as an Entrant’s job title, city, etc. collectively “Personal Information”), to populate the Client Relationship Management database. Data is internal to the Thompson Okanagan Tourism Association, and not intended for public disclosure. Sponsor is under no obligation to use an Entrant’s survey responses for any Survey Reports.
4. Important Contest Rules
4.1 Claiming the Prize: Claiming the Prize is subject to verification by Sponsor. Entries made with multiple addresses or identities or through the use of any device or artifice to enter multiple times or entries during the Contest Period are automatically void. All Contest entries which are incomplete, illegible, mutilated, altered, reproduced, forged, irregular, or fraudulent in any way or otherwise not in compliance with these Rules are automatically void. Sponsor will be the sole and final reference source in validating a Prize claim.
4.2 Participation: By participating, each eligible Entrant and the selected Winner agree: (a) to be bound by these Rules and the decisions of Sponsor, (b) to release and hold harmless the sponsor, their affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, agents, and representatives including advertising and promotion agencies, from any and all liability for any loss, harm, damages, cost or expense arising directly or indirectly, in whole or in part, out of participation in the Contest, breach of these Rules, participation in any Contest-related activity or the acceptance, use, or misuse of the Prize, including but not limited to costs, injuries, losses related to personal injuries, death, exposure to communicable diseases such as COVID-19, damage to or loss of or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; (c) to the collection and use of his/her/their personal information by Sponsor for Contest related purposes; (d) to grant Sponsor right’s to the Entrant’s Response in accordance with these Rules; and (e) to answer a skill testing question and sign a Declaration and Release Form if selected as the Winner.
4.3 Sponsors Decisions: The decisions of Sponsor in relation to this Contest will be final and binding on all Entrants.
4.4 Aberrations: The Sponsor shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, faulty, incomplete, incomprehensible, or erased computer or network transmissions, line failures of any telephone network, failure of computer equipment, software, inability to access any online service or web site, inability to submit the online survey, or any other human or technical error or malfunction, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest, or for late, lost, stolen, postage due, illegible or misdirected entries.
4.5 Rights of Sponsors: Sponsor reserves the right to cancel, terminate, or suspend this Contest, at its sole discretion, in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest.
4.6 Prize Award: Under no circumstances will Sponsor, its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies be required to award more Prizes than what is indicated in these Rules or award a Prize other than in accordance with these Rules.
4.7 No Purchase Necessary.
4.8 Personal Information: By participating in the Contest, each Entrant: (i) grants to Sponsor, along with rights granted above, the right to use their Personal Information for the purpose of administering the Contest, including but not limited to contacting and announcing the Winner and coordinating the provision of the Prize; (ii) acknowledges that Sponsor may disclose such Personal Information to third-party agents and service providers of Sponsor in connection with any of the activities listed in (i) above.
4.9 Law: The Contest is subject to all Federal, Provincial, and local laws, as well as the rules adopted in view of said laws. All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations as between the Entrant and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of British Columbia without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
